Data Protection Notice

General
The aim of this data protection notice is to inform you for what purposes the Else Kröner-Fresenius-Stiftung,
Louisenstraße 12061348 Bad Homburg v.d.H. (hereinafter “we/EKFS” or “us”) processes your personal data. Personal data is all information that relates to you personally. The following information is intended to help you to understand how your personal data is processed, and thus create transparency.

Processing of your personal data
The EKFS processes the following personal data relating to you personally for the following purposes:

1.  Personal data (name, address, e-mail address, institution and private contact details, position, function, date of birth, gender, account details) to review your applications and implement approval procedures;

2.  Personal qualifications (professional background, letter of recommendation) to check the formal requirements of the applications and examine the content of the applications.

Legal Basis
The legal basis for processing your personal data for the above-mentioned purposes is Art. 6, 1. (b) of the General Data Protection Regulation (GDPR), according to which the processing of your data is lawful, as this is carried out in order to take steps at your request prior to entering into a contract or where such processing is necessary for performance of the funding agreement.

The provision of your personal data is necessary to assess the approval of funding or to perform the funding agreement. Without processing your personal data it is not possible to review your applications for funding or carry out our approval procedure. Therefore, if you decide not to provide us with your personal data, we will not be able to review any funding and your application will have to be rejected for formal reasons.

EKFS does not make any decisions automatically that are based exclusively on automated processing, including profiling, and which have a legal effect or compromise you in a similar manner.

Deletion of data
The following overview shows the duration for which we store your personal data:

Regarding No. 1

  • Personal data in case of approval: 10 years after fulfilment of all contractual obligations
  • In case of rejection of funding application: 6 years after notification of the applicants

Regarding No. 2

  • Personal qualifications in case of approval: 10 years after fulfilment of all contractual obligations
  • In case of rejection of funding application: 6 years after notification of the applicants

Irrespective of the above-mentioned collection and deletion of your personal data, your address and personal contact details (name, address, telephone number, fax, e-mail) will be saved and used for future notifications concerning invitations to tender and events, as well as publications of the Else Kröner-Fresenius-Stiftung, provided that you have given your consent for this. Furthermore, there may be a legitimate interest on our part to carry out accompanying communication measures or tendering procedures on the basis of Art. 6 (1) f) DS-GVO, provided that no consent is required from you for these purposes.

This consent has been given voluntarily and may be informally revoked at any time from the Else Kröner- Fresenius-Stiftung,

Data Transfer
We transfer your personal data to the following categories of recipients: 

  • IT service Providers;
  • experts;
  • jury members;
  • consultants;
  • ForTra gGmbH für Forschungstransfer der Else Kröner-Fresenius-Stiftung.

In the event of the involvement of international experts and/or international jurors, who receive your personal data from EKFS, this natural person may be located in a country outside the EU. It is possible that this country may not have an adequate level of data protection compared with the level of data protection within the European Union. This means that the data protection laws in the country to which we transfer your data do not offer the same protection as in Germany.

EKFS processes your personal data mainly within Germany. Due to the use of various IT services, we may transfer your personal data within the EU and also to the USA and other countries whose data protection laws may be less comprehensive than those in the EU. Access to your personal data will be limited to natural persons who need to know this data for the purposes described in this data protection information. In principle, your data will be passed on to third countries with an appropriate level of data protection using appropriate protective measures.

In order to put the appropriate safeguards in place in such cases, to ensure data protection, we conclude agreements with the relevant individuals, to ensure adequate guarantees.
